The Commission, however, can take action under the FTC Act if a marketer makes an environmental claim inconsistent with the guides. In any such enforcement action, the Commission must prove that the challenged act or practice is unfair or deceptive in violation of Section 5 of the FTC Act. (b) These guides do not preempt federal, state, or local laws. The Green Guides, enforced by the FTC, explain standards for truth in green advertising. The Guides’ message for businesses: you must have sound science to back up the green claims you make for your products. The Guides’ message for you: when you shop, look for specific information on packages and products that explains why the product is getting a green promotion. If you don’t find those specifics, you can choose another product.
